Privacy Policy
The Radio Cult Station Web Services (“Web Services”) are owned and managed by Radio Cult Limited (“Radio Cult”, “we”, “us”, or “our”). This Privacy Policy applies to the Radio Cult Station Web Services.
Privacy is important to us. It is our policy to respect the privacy of all entities and legal persons regarding any information we may collect from interactions with our Web Services.
This Privacy Policy is used to inform transmitting entities (“entity” or “entities”) regarding policies on the collection, use, and disclosure of Transmitting Entity Information when using the Web Services. In addition, this Privacy Policy informs the legal person(s) (“user(s)”) who are associated with a transmitting entity regarding policies on the collection, use, and disclosure of Personal Information when using the Web Services. Any entities and any of their associated users who choose to use the Web Services, agree to the collection and use of information in accordance with this Privacy Policy.
1. Information Collection
1.1 Transmitting Entity Information
We may collect Transmitting Entity Information. Such information could include, but is not limited to, information that can be used to identify the transmitting entity (such as registered name, email address, and other identifiers), location information (such as registered and/or physical address) and payment information (such as credit card number), (collectively “Transmitting Entity Information”). The types of Transmitting Entity Information we collect may vary depending on how an entity uses the features of our Web Services. As an example, a credit card number and other payment-related information will be collected if an entity subscribes to a paid subscription within our Web Services.
1.2. Personal Information
We may collect Personal Information, information from a user who is associated with a transmitting entity that can be used to identify the user as an individual, such as name, email address, and other identifiers (collectively “Personal Information”).
1.3. Subscriptions
If an entity subscribes to a tier within the Web Services for which payment is required, payment details (such as credit card number) will be requested, so our service providers can process the necessary payments.
1.4. Communications
We will collect any information provided to us by either an entity or associated user(s) when communicating with our customer-support team.
1.5. Location Information
Any entity or associated user(s) who interacts with the Web Services, consents to our collection and use of the location information provided by the device used to interact with the Web Services. We may collect or infer information about the general location of any device that interacts with the Web Services if the device’s bluetooth, wi-fi or other geolocation functionality is turned on. We may use and share location information with certain third-parties for analytics, logging and payment purposes.
1.6. Listener Information
Individuals who listen to a transmitting entity’s radio station through the Web Services, including through embedded players or applications (“listeners”), are not required to create an account. When a listener accesses a station, we and our service providers may automatically collect technical information such as internet protocol (IP) address, approximate geographic location derived from that IP address, device and browser type, and listening activity (such as the station accessed and connection times). We use this information to deliver the audio stream, to apply any geographic access controls set by the transmitting entity, to measure audience and listener numbers, to prevent abuse, and to maintain the security and reliability of the Web Services.
Where a listener accesses a particular station, Radio Cult holds and handles listener information relating to that station as an agent of the relevant transmitting entity, and solely to provide the Web Services to that entity. Under the Privacy Act 2020 (New Zealand), information that Radio Cult holds as an agent is treated as held by the transmitting entity, which is responsible for how listener information relating to its station is collected and used, and for providing its listeners with any privacy notice required by law. Radio Cult handles listener information that it collects for its own purposes, such as platform security and aggregate analytics, in accordance with the Privacy Act 2020.
2. Information Usage
The information we collect from entities and users is used for a selection of business purposes. Such purposes include providing access to certain features of the Web Services. Under certain circumstances, location information may be shared with select third parties for analytics and logging.
3. Log Data
Third parties may record log data from crashes during the runtime of the Web Services. This log data contains no Transmitting Entity Information or Personal Information and is used purely for the detection and fixing of bugs within the Web Services..
4. External Services and Integrations
Radio Cult may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies. We recommend reviewing the privacy policy of these external services.
The Web Services also offer application programming interface (“API”) and Model Context Protocol (“MCP”) integrations that allow an entity or its associated users to connect third-party tools, including automation platforms and artificial intelligence assistants, and to access, export, or act upon their own data held within the Web Services. Where an entity or user chooses to connect such a tool, any information accessed through that integration is transmitted to and handled by that third party in accordance with the third party’s own terms and privacy policy, and not this Privacy Policy. The entity and its associated users are responsible for the tools they connect and for any information they access, export, or share through them. Radio Cult has no control over, and accepts no responsibility or liability for, how a connected third party handles that information.
5. Information Security, Access and Correction
We value the privacy of all entities and their associated users who interact with the Web Services. We make all reasonable efforts to protect the information stored in our Web Services. However, please be aware that we cannot ensure or warrant the security of any information transmitted to us. Subject to our obligations under the relevant privacy legislation, the use of the Web Services and provision of all information to us is done at the entity’s and associated users’ own risk.
Appropriate steps are and will be taken to ensure the Transmitting Entity Information and Personal Information we have collected or disclosed is accurate and complete. If such information changes or if you wish to correct any inaccuracies in the Transmitting Entity Information and Personal Information we hold, please contact us by email detailed below in the ‘Contact Us’ section.
At an entity’s request, we will provide a copy of any Transmitting Entity Information we hold about the entity, along with any Personal Information held for any associated user(s), unless we are exempt from doing so under any applicable privacy laws.
6. Changes
We may update this Privacy Policy to reflect any material changes to our information practices. If any such changes are made, we will make reasonable efforts to notify all entities prior to the changes becoming effective, either via email or through a notice on the Web Services.
